2. Introduction

2.1 These terms and conditions may change from time to time. Please visit https://www.onair.company/terms-conditions periodically to make sure that you are aware of the latest version.

2.2 These are the terms and conditions that apply to users of OnAir Airline Manager (also referred to as the “product”). If you do not agree to these terms, you must not purchase, download, install, use, play or otherwise access OnAir Airline Manager. By purchasing, downloading, installing, using or playing OnAir Airline Manager you are agreeing to the latest version of these terms and conditions.

2.3 You must be at least 13 years old to use this product. If you are 13 or over and of or over the age of majority in your jurisdiction, you agree to and accept these terms and conditions. If you are 13 or over but beneath the age of majority in your jurisdiction, you must obtain the agreement and acceptance of a person with parental authority for you and that person agrees to and accepts these terms and conditions.

2.4 OnAir reserves the right to change the gameplay details at any time. This cannot be a cause of refund.

2.5 We also sell this product through third party digital stores. If you purchase this product through one of those stores, you may need an account at that store and are subject to the terms and conditions of the third-party digital store.

2.6 Where applicable, the third-party digital stores may offer a refund in relation to this product. You will need to contact the third-party digital store directly in order to receive a refund since that is where the product was purchased.

2.7 If you purchased OnAir Airline Manager through the OnAir Company website, you have the right to revoke this contract within fourteen days without specifying any reasons. If you bought this product via a third-party digital store, please refer to section 2.6.
(a) The revocation period is fourteen days with effect from the day of the conclusion of the contract. However, once an activation code (Product Key) is redeemed, the right of revocation expires immediately. 

If you purchase OnAir Airline Manager Subscription, you agree that you would have immediate access to the digital content and acknowledge that thereby you waive your right to cancel once the service has begun. 

The order can not be refunded  when the key has been redeemed.

(b) In order to exercise your revocation right, you must inform us of your decision to revoke this contract by means of a clear declaration through our support plateform: https://onairhelp.zendesk.com/hc/en-ca/requests/new

You can use the sample revocation form (listed below) for this, which however is not mandatory. We will send you a confirmation (e.g. via email) about the receipt of such a cancellation.
(c) In order to safeguard the revocation period, it is sufficient that you send the notification about the exercise of the revocation right before the expiry of the revocation period.


(d) If you revoke this contract, we shall repay all the payments which we received from you immediately or at the latest within fourteen days from the day on which we received the notification about the revocation of this contract from you. We will use the same means of payment which you had originally used during the original transaction for this repayment, unless expressly agreed otherwise with you; you will not be charged any fees owing to this repayment.

3. Prices and payment arrangements

3.1 The prices mentioned in the respective offers represent total prices. They include all the price components, including all the incidental taxes.

3.2 The payment methods that are available to you are shown by clicking the appropriate button on our website or are disclosed in the respective quote.

3.3 Unless otherwise specified for the respective payment methods, the payment claims arising from the contract that has been concluded become payable immediately.

3.4 The OnAir Airline Manager subscription contract is a contract with a commitment of 1 month, 3 months, 6 months, 1 year or 2 years. This contract is automatically renewable. You can deactivate automatic renewal at any time through your Paypal account. Warning if you do not cancel you will be automatically debited at the end of the period.

4. How You Can Use This Product You can do the following:

4.1 Use this product in accordance with the terms and conditions;

4.2 Use this product to share non-commercial screenshots and videos of your gameplay on your personal social media accounts;

4.3 Use this product to utilize any upgrades, updates and additional OnAir Airline Manager content that we may make available from time to time. We reserve the right to not be obligated to provide upgrades, updates and additional product content.

5. How You Cannot Use This Product

You cannot do the following:

5.1 Sell, distribute or otherwise transfer copies or reproductions of this product to any third party in any manner;

5.2 Reproduce, translate, modify, adapt source code, disassemble, merge, decompile or create derivate works of this product in any shape or form;

5.3 Disable, circumvent or remove any proprietary labels, notices or copy protection software that is contained in this product;

5.4 Exploit the product for any commercial gain or purpose;

5.5 Use the product for any illegal or immoral purposes;

5.6 Export the product or any copy of the product in violation of applicable laws and regulations;

5.7 Copy, transfer, distribute, rent, lease, loan, sublicense or deal in this product in any way that violates the terms and conditions for this product;

5.8 If OnAir Company is sued or threatened because you violated any of the terms and conditions for this product, we may hold you responsible. As a result, you will need to compensate us or pay us back for any damage we suffer as well as for any legal costs and/or expenses.


6. License

6.1 OnAir Airline Manager and each or any part of it and any online service which is made available through it, including but not limited to its companion mobile applications for iOS and Android, are the intellectual property of OnAir Company. Any use, reproduction or redistribution of this product not in accordance with the terms and conditions is expressly prohibited.

6.2 OnAir Company provides a free trial of the product with full access to all of its features. This trial has to be used to test the compatibility of the product with your computer and its operating system and any flight simulators and addons that you plan on using alongside the product. After this free trial expires, you must purchase a license if you want to continue using the product. Each person can only take advantage of the free trial one time.

6.3 Upon purchase, you will receive a simple license for every downloaded product. If this is a paid subscription-based product, the license will grant you use of the product only for the duration of the subscription period.

6.4 The simple operating license grants permission to install and use the product at any one time, on a single computer for your personal, non-commercial use subject to these terms and conditions.

6.5 This product is licensed and not sold. Therefore, your license does not grant any title or ownership in the product. This product is protected by copyright laws, international copyright treaties and conventions and other laws.

7. Code of Conduct

7.1 OnAir Company encourages a respectful, friendly community for the product. When and where we make the functionality available, certain aspects of the product may include multiplayer, messaging other users privately or via live chat, and other multiplayer community functionalities. All users must act reasonably
and respectfully with other users, including on any online discussion forums that are operated or provided by OnAir Company. All hacking, cheating, bug exploitation, misuse of the product, trolling, deceptive or abusive conduct is strictly prohibited.

7.2 Encouraging rule breaking or abuse of game-play is not allowed. I.e showing the community how to hack, dupe, break rules, etc.

7.3 Starting, encouraging and contributing to server drama discussions is strictly prohibited and not allowed. Doing so will result in a ban.

7.4 You may not abuse other users, harass them or engage in trolling or stalking. You cannot share any content or use the product in any way that is immoral, unethical, hateful, offensive, libelous, defamatory, threatening, bullying, pornographic, vulgar, racist and/or sexually offensive.

7.5 Threads made to insult, offend or hurt other players, the staff, the community or the server is not allowed and will be locked/removed from public view on the first offence and result in a ban.

7.6 Farewell/goodbye or temporary leave threads are not allowed. This is because it just allows users to post-farm/spam goodbyes and most players that start these threads don’t actually leave or come back after a few months

7.7 You cannot cause any disruption to the product that interferes with its proper operation which includes damaging any account, software, hardware or network. You must not impersonate any person, including without limitation any staff of OnAir Company. You must not upload spam, commercial, marketing, advertisement or solicitation content or promotional content or any third party links.

7.8 Some features may have bugs. If you come across an issue allowing an exploit, you must make a bug report by going to this address: https://onairhelp.zendesk.com/
It is therefore strictly forbidden to exploit them voluntarily, otherwise a penalty will be attributed to your OnAir Company or VA

7.9 You are not permitted to buy or sell accounts to access this product.

8. Choice of law

8.1 French law shall apply. This choice of law only applies to customers if it does not result in the revocation of the protection guaranteed by the mandatory provisions of the law of the country in which the respective customer’s usual place of residence is located (benefit-of-the-doubt principle).

8.2 If you are not a consumer, but a businessperson, a legal entity under public law or an institutional fund governed by public law, our place of business is the place of jurisdiction as well as the place of fulfilment for all services that follow from the business relationships that exist with us. The same condition applies to situations in which you are not associated with a general place of jurisdiction in France or the EU, as well as situations in which the place of residence or the usual place of residence is not known at the time of commencement of proceedings. This has no bearing on the capacity to call upon the court associated with another place of jurisdiction.

8.3 The provisions of the UN Convention on Contracts for the International Sale of Goods are explicitly inapplicable.

9. Liability

9.1 Installation and use of this product which includes any upgrades, updates, and other related items are at your own risk.

9.2 This product does not contain any guarantee of any kind. There are no express or implied warranties of any kind. You accept this product as is.

9.3 OnAir Company does not warrant that the use of the product will not be interrupted or error/bug free or that it will not cause any issues with your computer and/or device. OnAir Company shall be informed of such errors/bugs and given reasonable time to correct any errors or bugs that may arise.

9.4 OnAir Company reserves the right to change the gameplay details at anytime

9.5 OnAir Company excludes any and all liability for all representations, warranties, conditions and other terms which are not mentioned in these terms and conditions.

9.6 OnAir Company is not liable for any consequential loss or damage that arises due to use of or inability to use this product, any damage to property such as computer failure, malfunction, loss of data or any issue that may arise due to negligence of the user.

9.7 These terms and conditions shall not limit or exclude any rights that you might have as a consumer that may not be excluded or limited as according to applicable law.

9.8 Service-level agreement (SLA)OnAir offers a best-effort guarantee to its services. This means that we will do our utmost to keep our servers available for users. Apart from scheduled downtime for maintenance, it is possible that something goes wrong and needs to be corrected. We promise that we will always do our best to sort out these issues as fast as possible. For shorter outages we will not offer any compensation if the outage is longer (1 day) we will add those days to the account. Please keep mind that hardware can fail and that there is a lot of internet between our servers and your computer. If you can’t reach our servers check the Discord channels to see if others see the same. If that is the case there is no need to send in a ticket. If you seem to be the only one feel free to send us a ticket

10. Operating System Requirements

10.1 Internet connection and a valid e-mail address are required to use this product.

10.2 Before you purchase the product, please ensure that your computer meets the following requirements: Windows 10 (64 bit) i3 Core processor 1 GB graphics card 8 GB internal memory 100 MB diskspace 1024 x 768 resolution

11. Termination

11.1 OnAir Company has the right to terminate these terms and conditions and your license to use the product and any related content should you breach the terms and conditions. If this should happen, you are required to immediately remove the product from your computer and/or devices and you must certify to OnAirCompany that this was done in writing via email.

11.2 You may terminate these terms and conditions at any time by deleting and removing this product from your computer and any other devices.
